What Nebraska Law Covers Under Drug Distribution
NRS 28-416(1) prohibits manufacturing, distributing, delivering, dispensing, or possessing with intent to distribute a controlled substance outside what the Uniform Controlled Substances Act permits. Distribution doesn’t require money to change hands. Any transfer of a controlled substance to another person qualifies, which is a broader definition than most people expect.
Nebraska classifies controlled substances into five schedules under NRS 28-405, and the schedule of the substance involved directly determines how severe the charge may be. Possession with intent to distribute is charged as a felony regardless of quantity. Intent is the key element, and prosecutors build their case on circumstantial evidence: the amount found, how it’s packaged, what was nearby, and what was said. Distribution is treated more harshly than simple possession because Nebraska law regards it as a threat to the broader community, not just the individual.
